INTRODUCTION
The Occupational Safety and Health Act 1994 is an important piece of legislation in Malaysia, as it governs safety and health at the workplace. However, due to the rapid changing industrial landscape in the country, there was a need to amend the current Act. This resulted in the Occupational Safety and Health (Amendment) Act 2022 that was gazetted on 16 March 2022.
The amended OSHA introduces 27 new sections, the removal of 2 sections, the amendment of 35 existing sections, the repeal of the Factories and Machinery Act (FMA) 1967 and the integration of FMA provisions and OSHA into one thorough safety and health legislation.
The amended OSHA aims to provide workers a safer and healthier environment at the workplace, a more self-regulated industry and increased responsibilities for employers. Employers should take the initiative and make plans to accommodate these incoming changes to the Malaysian workplace, as only time will tell whether this amended OSHA can achieve its goals.
